Terms of Service

1. Acceptance of Terms

By accessing or using QuestERide ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, please do not use the Platform.

2. Description of service

QuestERide is a long-distance rideshare marketplace intended to connect drivers already traveling a route with riders heading the same way. Drivers post routes, dates, and per-seat prices; riders may bid to ride along. We do not provide transport services and are not a common carrier, taxi, or limousine service.

3. Eligibility

To use QuestERide you must:

• Be at least 18 years old.
• Have the legal capacity to enter into a binding contract.
• Register with accurate, current, and complete information.
• Comply with all applicable local, state, and federal laws.

4. Driver requirements

Drivers who offer rides through the Platform, when the service launches, must maintain a valid U.S. driver's license, personal auto insurance that complies with their state of registration, and a vehicle in safe operating condition. Drivers must complete any identity verification and background checks we require before accepting riders.

QuestERide does not currently provide, and has not placed, any commercial auto or umbrella liability policy. Any future insurance or coverage program will be described in a separate rider or update to these Terms before it takes effect.

5. Rider responsibilities

Riders must:

• Provide accurate pickup and drop-off information.
• Communicate clearly with the driver and arrive on time.
• Comply with the driver's reasonable vehicle rules and all laws.
• Pay any agreed price through the Platform's payment processor when trips are offered.

6. Payments and fees

QuestERide's planned platform fee is 5% from the rider and 5% from the driver (10% total), subject to change before launch. No fees are being charged today. All payment terms, refunds, and payout schedules will be disclosed before any paid trip is confirmed.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. QUESTERIDE DOES NOT GUARANTEE THAT ANY DRIVER OR RIDER WILL BE AVAILABLE, THAT ANY TRIP WILL OCCUR, OR THAT ANY USER IS WHO THEY CLAIM TO BE.

Transportation arranged through the Platform is a private arrangement between the driver and rider. QuestERide is not responsible for the actions, conduct, negligence, or insurance status of any user.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUESTERIDE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless QuestERide from any claim, demand, loss, or damage arising out of your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, the Platform, or third parties.

11. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after any changes means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Platform will be resolved in the state or federal courts located in Alabama.
